ACCEPTABLE USE POLICY (AUP)

This Acceptable Use Policy ("AUP") governs your use of the services provided by Xcobean Systems Limited ("Xcobean", "we", "us" or "our"). It applies to all Hosting Services, Domain Services, VPS, Dedicated Servers, reseller services and any related products provided through our websites.

This AUP forms part of, and must be read together with, our Terms and Conditions and Privacy Policy. By using our Services, you agree to comply with this AUP.

1. GENERAL OBLIGATIONS

1.1 You must use the Services only for lawful purposes and in accordance with:

  • the laws of the Republic of Kenya;

  • applicable international laws and regulations; and

  • all registry, network, and provider policies.

1.2 You are responsible for all activity carried out using your account, whether by you or by any third party.

1.3 If you are using a Reseller Service, you are responsible for ensuring that your customers comply with this AUP. Any breach by a third party shall be treated as a breach by you.

2. RESOURCE USAGE

2.1 Shared Hosting Services are intended for normal website usage and content delivery.

2.2 "Unlimited" storage is subject to fair use and must not be used for:

  • file distribution;

  • backup storage;

  • media streaming platforms; or

  • cloud storage services.

2.3 Where excessive bandwidth or system resources are used, Xcobean reserves the right to impose limits, throttle usage, suspend services, or require an upgrade.

2.4 Unless you are using a VPS or Dedicated Server, you must not:

  • consume more than 10% of server CPU or memory resources;

  • run background or unattended server-side processes;

  • run IRC, torrent, peer‑to‑peer, gaming, mining, or indexing services;

  • operate proxy, VPN, file‑sharing, or cloud‑storage services;

  • host malware, scripts, or software that disrupts server stability.

2.5 Files stored on shared hosting must be web‑accessible and related to the hosted website. We may remove non‑compliant files without notice.

3. PROHIBITED USES

You must not use the Services to:

  • engage in unlawful, fraudulent, deceptive, or malicious activity;

  • harm, exploit, or attempt to harm minors;

  • transmit malware, spyware, ransomware, or malicious code;

  • conduct phishing, spoofing, or impersonation;

  • interfere with network security or system integrity;

  • violate intellectual property rights;

  • host content that is illegal, obscene, defamatory, hateful, or abusive.

4. CONTENT STANDARDS

4.1 Content hosted using our Services must:

  • be lawful;

  • be accurate where factual;

  • not mislead users;

  • comply with Kenyan law and applicable international standards.

4.2 Content must not:

  • be defamatory, obscene, or pornographic;

  • promote violence, discrimination, or hatred;

  • infringe copyright, trademarks, or privacy rights;

  • impersonate any person or organisation;

  • falsely suggest affiliation with Xcobean.

5. ZERO‑TOLERANCE SPAM POLICY

5.1 Xcobean maintains a strict zero‑tolerance policy against spam.

5.2 You must not send unsolicited bulk email, messages, or advertisements of any kind.

5.3 Any account responsible for spam, or that results in IP blacklisting, may be suspended or terminated immediately.

5.4 Xcobean may charge cleanup, remediation, and blacklist‑removal costs incurred as a result of spam activity.

6. SECURITY AND ABUSE

6.1 You must take reasonable steps to secure your applications, scripts, and credentials.

6.2 Compromised accounts may be suspended without notice to prevent harm to our systems or other customers.

6.3 Xcobean may cooperate with law‑enforcement authorities where required by law.

7. SUSPENSION AND TERMINATION

7.1 We reserve the right to determine, at our discretion, whether a breach of this AUP has occurred.

7.2 Actions we may take include:

  • issuing warnings;

  • suspending or terminating Services;

  • removing content;

  • reporting activity to authorities;

  • recovering costs arising from the breach.

7.3 Suspension or termination under this AUP does not entitle you to a refund.

8. CHANGES TO THIS POLICY

We may update this Acceptable Use Policy at any time. Continued use of the Services constitutes acceptance of the revised policy.

Xcobean does not provide legal, regulatory, or compliance advice. You are solely responsible for ensuring that your use of the Services complies with all applicable laws and regulations.
